Therefore, the contribution of the expert opinions and their investigations is limited.
- The expert on behalf of the plaintiff, Mr. Asher Asban, noted in his opinion the differences in the levels that were created between the road and the metal frame of the cattle crossing, and in particular in the direction of travel in which the plaintiff and the defendant traveled, and determined that there is a "step", where, according to the measurement, the vertical difference is between 2 cm and 8 (-) cm, and the horizontal difference between the metal beams and the asphalt ranges from 0 cm to 7 cm. It was also noted that on the surface of the metal there are signs of groove and bending from the north, which is the direction of travel of the parties at the time of the incident. In addition, it was noted that there is no warning sign before the crossing when driving from the north, unlike the cattle prevention crossings further down the road.
Mr. Asban determined that "during the course of the incident, the plaintiff experienced a number of impacts" as a result of the horizontal groove in the connection between the asphalt and the metal frame; a vertical level difference between the metal frame and the asphalt; and a significant gap of about 15 centimeters between the metal beams that formed the lattice. The expert explained that this was a "synergistic accumulation" of injuries created during the incident as a result of the plaintiff sitting in the back seat, and that there was a difference between the impact of the incident on each of the riders. In the front seat, the jump is relatively restrained due to the fact that the driver leans forward and pushes the front part using his body position, and in addition, the rider is aware of the incident, stiffens his body and clings to the motorcycle with his hands and legs. However, the passenger in the back seat is unaware of the obstacle, and his body is relatively loose and goes up with the back of the motorcycle. As to the mechanism of the injury, the expert described that in a situation where the plaintiff's body is detached from the back seat of the motorcycle, when she lands, the motorcycle mounts up (the brakes "open"), in a manner that intensifies the injury. The expert later noted that even when driving his car on the cattle barrier, vibration was created due to driving across the gaps of the metal beams.
