Later, the expert replied that there is a possibility of the rider jumping to a height of 25 centimeters in the back seat when the motorcycle remains stable while driving on the road, even at a speed of 60 kilometers per hour, due to the fact that it remains perpendicular to the road.
When the expert was asked to assess the height to which the plaintiff's body rose at the time of the incident, he replied: "I know how to estimate, my estimate is my estimate, OK? It is a few tens of centimeters 10, 20, 30" [Prov. lines 33-34 on p. 56]. The expert fairly admitted that he did not take measurements, and that for this purpose the motorcycle itself and the brakes must be examined, while it is possible to conduct an engineering test regarding the piston force, braking force and weight, the type of tire, brake adjustment, and so on, physical data that were not actually tested.
The expert clarified that according to his professional opinion, the plaintiff's version is possible and plausible according to the conditions of the area [Prov. at p. 58].
- The defense's expert, Mr. Liran, was also questioned at length about the opinion. During his interrogation, the expert noted that the road to the cattle crossing was a bend and a moderate ascent for about 300 or 400 meters, which he estimates to be 10 degrees, after he noted in the opinion that the ascent was sharp. Liran explained that the driver is supposed to press the accelerator pedal at the beginning of the ascent, but even in this situation the speed is supposed to decrease due to the heavy weight on the scooter, which has a very small engine compared to other motorcycles.
As to the specific point of the trip to the cattle crossing, Mr. Liran testified that when he visited the place with the plaintiff she refused to allow him to document and photograph her, and therefore he sufficed with her statement that the trip was in the center of the crossing, without asking her to point to a specific place. The expert argued that although the height of the step on the right side of the passage reaches 10 cm, it is decreasing in the slope, so that in the location in the center of the crossing where the ride was made, the height of the step is 1 cm. When asked what was the height of the step at the location of the metal strip that crossed the passageway, he estimated that the height was 3 cm, without taking any measurements.
