The prosecution expert also referred to the difference in the intensity of the experience of driving on an obstacle between the driver riding the motorcycle when he is leaning forward, holding the vehicle well and aware of the road conditions and disruption on the road, and the rider in the rear, whose body is relatively loose, his grip is less, his seat is higher and he is unable to anticipate the event and step on his body in defense of it. This distinction, together with the explanation of the action of the rear brakes and the effect of releasing the springs, can explain the difference between the parties' versions in the description of the incident - while the defendant felt only a tremor or a small jump, the plaintiff felt a jump in the air and a painful blow. Although this is a matter of expertise, the defense expert did not address this distinction at all, and it was not contradicted.
The defense expert, who categorically ruled out the possibility that there was a jump in the opinion, and referred mainly to the extreme version that was presented to him of a jump to a height of 40 centimeters, admitted during his testimony that there may have been a jump, but only to a height of a few centimeters. While watching the video filmed by the defendant, the defense expert agreed that there was a jump by the two vehicles while driving on the cattle crossing, and his main claim was that the motorcycle passed through the center of the crossing and therefore did not cause a similar jump. His testimony contradicted the words of the defendant in the video itself, who claimed that at most the vehicle was caused by a shaking, and not a jump as the expert noted. The defendant even said in the video that when a motorcycle passes, "the vibrations are a little stronger" than when the vehicles filmed in the video passing, and this is also contrary to the position of the expert on his behalf.
Thus, the expert on behalf of the defense changed his position to some extent, when he admitted during his interrogation that there may have been a jump, even if it was significantly smaller; when he defined the ascent towards the passage of the cattle predator as a moderate increase with a slope of about 10 degrees, while in the opinion he noted that the ascent was sharp; He agreed that the speed of the motorcycle at the time of the passage may have been about 40 to 50 kilometers per hour, while in the opinion he stated that it was not possible that the speed was high.
