The medical documentation and testimonies about the plaintiff's condition after the incident
- The plaintiff described that during the week following the incident, she rested at her home, and used ointment, painkillers and a heating pad, hoping that the pain would pass. On Sunday, April 22, 2018, she went to work, but on the same day she received a hearing letter before being fired and returned home. The plaintiff testified in her interrogation that at this stage she had not yet sought medical treatment because she thought she could overcome the pain on her own. The witness on behalf of the plaintiff, Mr. Z. (hereinafter: "the neighbor"), who had been a neighbor of the plaintiff in a subdivided apartment for several years and a close friend, stated in his affidavit that he first heard about the incident the day after Independence Day, when the plaintiff told him about the incident and suffered considerable pain in his back and buttocks, which radiated to his leg. During his interrogation, the neighbor stated [Prov. lines 4-7 at p. 61]:
"First of all, I think if I'm not mistaken, I met her the day after she told me that they were riding a motorcycle, that they went in my opinion, if I remember correctly it was to see the Independence Day flyover and there was some kind of accident on the way she got a very, very serious blow to the back."
Later, the neighbor testified that a short time later, the plaintiff's mother came and took her for medical treatment, and insisted that he met the plaintiff on the evening of Independence Day or the day after.
- In practice, the plaintiff sought medical treatment a week after she returned home. According to the plaintiff, on Friday morning, April 27, 2018, she woke up suffering from excruciating pain and movement restrictions, and radiation to her left leg was accompanied by a burning sensation. The plaintiff called her mother and asked her to come and take her to an emergency medical center. Due to the pain, the plaintiff refrained from changing her clothes and descended the stairs very slowly. At the emergency center, the plaintiff was referred for an X-ray and received three injections, and then stayed at her parents' home for several days.
In her interrogation, the plaintiff reiterated her remarks and said that that morning she woke up suffering from excruciating pain and a burning sensation in her lower back and leg, which began a week after the incident and therefore called her mother. The plaintiff testified that due to the pain she suffered, she descended 40 stairs very slowly and reached the car shaking with pain. Her mother drove her to the entrance to the emergency medical center, where she was immediately admitted for treatment after the nurses saw that she was bent and in severe pain.
