These findings are clear, which are well consistent with the plaintiff's complaints. The fact that the disc protrusions appeared only shortly after the event, and there were no findings prior to that, constitutes additional circumstantial evidence, which strengthens the causal connection to the jumping event while driving on the cattle propulsion crossing, as also determined by the orthopedic expert.
- In the court-appointed orthopedic expert opinion, Dr. Raphael Lotan, dated December 1, 2019, a detailed review of the medical documentation in the plaintiff's case was conducted. In the description of the case, it was recorded that while the motorcycle was passing over a cover on the road, the motorcycle jumped and the plaintiff jumped about 40 centimeters above the colony and returned to the colony, and immediately afterwards felt pain in her left buttocks.
The expert noted that the plaintiff was asked why she had indicated that she had undergone a massage at the medical center a few days earlier, and she replied that she had undergone a massage in Nablus and not in connection with the pain resulting from the accident. It should be noted that the description of the plaintiff's statements to the expert contradicts her testimony that she did not undergo any massage during the relevant period, and is consistent with the data stated in the initial medical documentation. All of this gives the impression that the plaintiff tried to conceal the fact that she received a massage, in order not to detract from her claim that she suffered an injury as a result of the blow she sustained while driving on the cattle crossing; However, the expert expressed his opinion that in any event it is unlikely that the plaintiff's condition was caused by massage, and therefore it has no effect.
Dr. Lotan conducted a comprehensive clinical examination of the plaintiff, and in the summary of the opinion determined that the supplier was acting in her favor:
"There is a lack of clarity regarding the mechanism of the accident and the time gap between the complaints regarding the accident and the accident itself, but since this is a gap of two weeks, and since there is doubt, the doubt is in favor of the plaintiff, I find a connection between Ms. N.'s complaints and the accident in question."
