Regarding the course of the meeting, the notary testified that "she comes to me and tells me that I have been sitting on my heart and head for a long time, I want to make a will. What do you want? She says I want to leave all my possessions to Ilan and Deborah. I asked her, after all, I know the family, I know there are 2 other children. I asked why it was only them, she told me that she was nicely organized, her children are mature, Reuven is financially organized, he has a very successful business, Ilan is unorganized, relatively financially, he has 3 school-age children and Deborah is divorced with 2 daughters so I want to take care of both of them, I asked her if you want to write in the will, she asked if I had to, I told her she didn't have to, she said I do with my property what I want... After I read the will to her, she was coerced and said, God forbid, what happens if Ilan or Deborah dies, I asked what you want it to be, she said I want it to go to their children, I said that's what the law says." (p. 12, s. 29-33, p. 13, s. 1-10 of the minutes of the hearing of October 18, 2021).
It should be noted that the deceased knew the notary and that the notary knew the entire family for many years, represented the plaintiff as well as the deceased son, the notary was also present at the funeral and also reached seven (pp. 10, 33, p. 11, 1-7 of the transcript of the hearing dated October 18, 2021), a matter that supports his declaration of acquaintance beyond the attorney-client relationship.
The fact that the deceased was a neighbor of the notary was also confirmed by the objector in his testimony (pp. 28, 20-23 of the minutes of the hearing of June 9, 2022) and by the objector (ibid., pp. 41, paras. 10-12).
The notary also testified that the deceased was in his office several times after the will was drawn up and according to his testimony "She called me on two or three matters after the will was made, and in no conversation was the will mentioned the things for which she called." (p. 13, paras. 11-13 of the minutes of the hearing of October 18, 2021).
