Bat/179 Shadi was asked about the time of the incident, and during his interrogation he was asked about the events of the day and whether they could assist in locating the point in time of the incident. Shadi says that it was definitely daylight (Q. 350-351) even when they finished loading the weapons (Q. 354-355). He replies that it was noon (Q. 337) and he is not sure, but it seems to him that it was before 4:00 P.M. (Q. 342-343).
Shadi reiterates in another testimony dated July 17, 2016 (P/187) that at the time of the break-in, Adi let him talk on the phone about a man who threatened him, and when asked what time it was, he replied, "I'm thinking at noon. I don't remember an hour" (Sh. 216)
In his testimony dated 20 July 2017 (Exhibit 189), Shadi relates that after the weapons transfer incident they (he and Adi) went to sit in Rahat in a hookah, and he replies that the day was there "less than forty minutes" (Question 132) and that they returned to the base in the afternoon, not evening or morning for sure (Question 136-137).
As mentioned, the information was also cross-referenced with security photographs, cell phone locations, and documentation from Highway 6, as will be detailed below.
In addition, according to the security camera footage taken at Beit Kama on 29 April 2016, photographs of Shadi's car arriving at the scene, and the rest of the photographs that are consistent with Shadi's testimonies, including his father's purchase of water, are between 1:02 P.M. and 1:16 P.M. In other words, the transfer of the weapons took place at these hours on April 29, 2016, and according to Shadi's testimony, after the burglary and theft, the trip was to Beit Kama, that is, on the same day.
From all of the above, it should be determined that the date of the burglary incident did indeed take place, as stated in the indictment, on the afternoon of April 29, 2017.
From all of the above, the description of the incident of burglary and theft of the weapons, as stated in the indictment, was also proven by evidence - it was proven to me, beyond a reasonable doubt, that on September 24, 2017, the break-in and theft of the weapons from the military base was carried out, under the circumstances of the execution as detailed in the indictment.
