The defendant, as aforesaid, claims his innocence and that he was not involved in the affair of the theft and transfer of the weapons, whereas these claims are inconsistent with his explicit statements in his interrogation in the framework of P/172B, and when asked about the contradiction, he casually replies that he "flowed" with the interrogator and her words, that he was not a detail about the types and quantities of weapons, but rather that he received information directly from the interrogators themselves and that he "flowed" with them and later responds that he knew that "there were rumors" (Pro. of May 8, 2017, p. 325, questions 18-24, p. 326, questions 1-22, questions 31-32, p. 327, questions 1-10, questions 20-32, p. 328 1-2, S. 15-18).
Summary of the defendant's statements and testimony - from all of the above, both from the testimonies of the policemen, from a review of the interrogation disc of August 2, 2016 and from viewing the recording disc, and from the defendant's testimony in court, I find that it has been proven before me, beyond any doubt, that the defendant made a clear admission that the weapons were transferred to his car, in his presence, saying that Shadi received 3 times money, mentions details about the weapons, asks for the renewal of negotiations for its return.
On the other hand, his testimony in court is not credible, and is inconsistent with previous versions he gave in the framework of P/172, nor with external evidence, some of which will be detailed below, regarding the location, locations, security cameras and data from Highway 6.
Since the minor argument was rejected, his confession in the framework of P/172 is admissible.
