A lawsuit that claimed copyright infringement of the plaintiff in the framework of an academic article published by the defendants. The remedies requested are monetary compensation without proof of damage in the sum of ILS 300,000, as well as injunctions and injunctions to stop and remove the alleged infringement.
Background
The Parties
- Plaintiff 1 (hereinafter: the plaintiff) is a researcher and senior lecturer in the Faculty of Industrial Engineering and Management at the Afeka Academic College of Engineering. She specializes in global operations and quality management in multinational companies. In this field, she wrote her doctoral dissertation in 2012 at the University of Haifa, entitled: "Quality Management in Global Organization: A Model for Functional Global Integration on the Network Basis of the Quality Systems."
The plaintiff has published 12 books, including the book "Globalization, Quality and Everything in Between," which was published in 2014. She has also published various articles, some of them in collaboration with Prof. Amos Nota, who served as her doctoral supervisor (hereinafter: Prof. Nota). Prof. Nota is the founder of the Quality and Reliability Engineering Program at the Technion and the person who headed it for 20 years, and supervised 25 doctoral dissertations. He currently serves as the head of the Quality Assurance and Reliability track in the Faculty of Industrial Engineering and Management at HIT College.
Plaintiff No. 2, the plaintiff's husband, is the owner of the publishing house "Logic Consulting and Training Systems". Among other things, he published the book that the plaintiff wrote in 2014.
- Defendant 1 (hereinafter also: Ms. Agmon) is a doctoral student in the Department of Industrial Engineering and Management at Ariel University, under the supervision of defendants 2 and 3. In January 2021, she submitted her doctoral research proposal entitled: "A Global Quality Management System Model (G-QMS) in System of Systems (SoS) using a Systems Approach/System Thinking". Subsequently, Ms. Agmon conducted a pilot study that included interviews with 7 experts, and on June 20, 2021, she presented it to an examining committee that included defendants 1-2, Prof. Nota (who was also one of the interviewees) and two other academics.
Defendant 2 (hereinafter: Dr. Cordova) is an industrial and management engineer who acquired her academic degrees at the Technion. She serves as a faculty member in the Department of Industrial Engineering and Management at Ariel University. According to the statement of defense, she has published 43 academic publications in the fields of industrial engineering and management and systems engineering, developed 6 textbooks, and lectured at leading international conferences. She has facilitated over 30 master's research projects in industrial engineering and systems engineering management and supervises three doctoral students.
