The defendants will therefore compensate the plaintiffs in the sum of ILS 15,000.
Conclusion
- We are dealing with plaintiffs who ordered a pergola for the balcony of their apartment from defendant 1 through defendant 2. The pergola never arrived, but for a year and four months, defendant 2 'pulled' the plaintiffs with promises and stories that were not proven.
- In light of this conduct, it was determined that defendant 1 had breached the agreement with the plaintiffs and that defendant 2, as an organizer of the company that made the false representations, was personally liable for the plaintiffs' damages.
- Defendants 1 and 2, jointly and severally, will therefore pay the plaintiffs the reimbursement of the advance in the amount of ILS 42,910 as well as compensation for emotional distress in the amount of ILS 15,000, for a total of ILS 57,910.
Defendants 1-2 will bear the plaintiffs' legal expenses and attorneys' fees in the total amount of ILS 10,000.
The sums will be paid within 30 days from the day on which they will be subject to interest linked by law.
- The claim against defendant 3 is dismissed, but given the severity of the conduct of defendants 1-2 and the joint representation, I have not found it necessary to award costs to the plaintiffs' obligation in this matter.
