- This indictment is attributed to defendants 1-4 (defendant 4 was added during the evidentiary hearings, after the seventh indictment was amended), and it includes the following offenses:
- forgery of a document with the intention of obtaining something through it under aggravated circumstances, according to Section 418 Law The Penalties (2 offenses).
- Use of a forged document, according to Section 420 Law The Penalties (2 offenses).
III. Fraudulent receipt under aggravated circumstances, according to Section 415 Law The Penalties (2 offenses).
- Receipt of assets obtained by crime, according to Section 411 Law The Penalties (for defendant 4 only).
In this indictment, it was alleged that on a date that is not known to the accuser, in the summer of 1999, defendants 1-3 contracted with the company through the firm "Forum Office Import and Export" "Cotradis S.A" from Luxembourg, in a transaction for the purchase of laptop-type goods. This, as it were, for someone who was envisioned to be a company in the name of "ICC LTD" From Beit Jala. Here, too, we are dealing with the payment of the consideration by the method of documents to the collector.
On one day in August 1999, the goods were received in Israel, and the import documents were received at the Heights Bank.
The indictment alleges that the defendants took a copy of the bill of lading prepared for the order of the collecting bank, and stamped a forged bank stamp on it, without paying the consideration for the goods, and without the bill of lading being redeemed by them and lawfully transferred in their favor by the collecting bank.
The defendants attached to the counterfeit bill of lading a sales account in the amount of 3,288,800 French francs, bearing a forged stamp of the bank of the collector.
The forged bill of lading and the bill of sale bearing the forged stamp were handed over by the defendants to the customs broker, "Shai Customs Agents 1997 Ltd.", according to which he drew up an import register and paid the import taxes for the defendants, and he even released the goods for them.
