The intention of the fraud is to obscure the fact that he is behind the establishment of the ICT and JCC companies and is the one who operates them for his criminal needs.
This offense was not attributed to the defendant in the indictment, but during the trial, the prosecutor, Adv. Noam Uziel, announced that the prosecution may ask the court to convict the defendant of this offense, and there is no doubt that the defendant and his attorneys were given a reasonable opportunity to defend themselves against the offense, as required by section 184 of the Criminal Procedure Code.
I convict defendant 4 of the offense of receiving assets obtained in a crime, under section 411 of the Penal Law, and acquit him of the other offenses attributed to him, by reason of doubt, in the framework of this indictment.
Charge No. 5
- In this indictment, it was alleged that defendants 1 and 4 contracted with the European Technical Trading from Luxembourg, in a transaction for the purchase of computer processor-type goods, allegedly, for a company ICC from the Palestinian Authority.
The facts alleged in this indictment are identical, with the necessary changes, to those detailed in the fourth indictment.
In this case, a supplier's account in the sum of $120,580 was issued, while a false supplier account was attached to the import license by a company Trust Exports Pte Ltd, for only $29,740.
Here, too, the goods were released by the same method, i.e., the presentation of a copy of a bill of lading, on which a forged stamp of the Arab Bank was stamped, with the relevant material being delivered to the customs broker, Noah Niv, by Yehoshua Shlosh, on behalf of the JCC company, which was established for the benefit and service of Yehoshua Shloush and defendant 1.
The customs broker paid reduced import taxes, NIS 20,924, while he had to pay an additional sum of NIS 63,912 according to the real supplier's account.
Here, too, the goods were received by defendant 4, Avi Kalamaro, for OPCI, and were sold at prices about 40% lower than the price stated in the real certificate of supplier.
