Defendants 1 and 3 will be convicted of the offense of attempting to receive something fraudulently under aggravated circumstances, under section 415 together with section 25 of the Penal Law, for the unsuccessful attempt to receive the goods fraudulently.
Only Defendant 1 will be convicted of offenses under the Customs Ordinance and the VAT Law, as far as the submission of the forged supplier's invoice is concerned, with the intention of evading the payment of import taxes, which derive from the true cost of the goods.
Defendant 4 will be convicted of the offense of attempting to receive assets obtained in the crime, under Section 411 together with Section 25 of the Penal Law. This is because, in the end, the goods were not received in his possession, but the import boxes were, as stated, a dummy bomb.
Defendant 4 will be acquitted, due to doubt, of the other offenses attributed to him in the framework of this indictment.
Charge No. 7
- In the framework of the seventh indictment, after it was amended, it was alleged that defendants 1 and 3 contracted, in the summer of 1999, through the firm "Forum Office Import and Export" with the company Cotradis S.A from Luxembourg, in a transaction for the purchase of laptop-type goods., allegedly for a company ICC from the Palestinian Authority. Here, too, we are dealing with a transaction, according to which the consideration will be paid by the method of documents to the collector. Accordingly, the goods were received in Israel in August 1999, and the import documents were sent to the Arab Bank in Ramallah.
The goods were released through the customs brokerage firm "Yeshline Customs Agents (1997) Ltd.", after Yehoshua Chelouche contacted the firm's manager, Shmuel Arsban, and handed him the handling of the release of the goods. The paperwork, brought by Yehoshua Shlosh, included a copy of a bill of lading bearing a forged stamp of the Arab Bank in Ramallah.
According to the testimony of Shmuel Arsban, Yehoshua Shlosh told him that he represented ICT, which is a company he manages.
