As stated, defendant 1 denies the claim that appears in the indictment, according to which he was involved in the submission of import licenses on behalf of the Danidov company to the Customs Authority.  According to him, he did not attach to any import license a document that was predicted to be a sales account of the Planas company.  The import receipts were submitted to the customs brokers by Yigal Fadlon on behalf of Danidov and included the documents transferred from OPCI, including the sales account of Planas that was transferred to Danidov by defendant 1.

The main argument of defendant 1 is that his entire involvement in the transactions in question was in the provision of brokerage services between various parties, at certain stages of the transaction.  Thus, defendant 1 mediated between Wagman and Plan.  Later, after Plans was unable to find buyers for the goods in Europe, Plans mediated with Danidov.  After it was clarified that neither Plan nor Danidov could open documentary credit, Defendant 1 mediated between them and OPCI.  After it became clear that OPCI had taken advantage of the obligo in the bank, OPCI mediated between OPCI  and Defendant 5 and Kirosel.  After Yigal Fadlon approached Defendant 1 and sought to prevent the harm to the exclusivity in the market, Defendant 1 mediated between Fadlon and "Haim" from the company of Danidov and Sevilla.  All of the aforementioned brokerage services were carried out with the aim of bringing about the completion of the transactions, since only at the end of the execution will defendant 1 be able to collect his commissions for these brokerage activities.  In addition, defendant 1 provided services of assistance in drafting the letters of credit to O.  PCI, in order to ensure the proper realization of the above complex transactions.

In addition, defendant 1 provided additional services to the Danidov and Savilla companies, namely assistance in drafting and printing various professional documents, and also assisted Danidov in organizing the financing of the release taxes that had to be paid for the goods in question, by way of check discounting.
