The defense believes that Lo Duque's testimony was credible and reliable, and that it contains many signs of truth. The prosecution's claim that he was an impostor witness, who had nothing to do with the transactions in question, remained a mere claim that was not proven at all. The testimony of Araldo Friesi, in this context, is also nothing more than a broken reed. This testimony is tendential, vindictive, full of contradictions and refutations, and has no evidentiary weight.
Frizzi confirmed that Planes was a company he owned, but claimed that it was an inactive company, and that he had never known a person named Christian Roger and that no one had operated the company for him in Belgium.
In addition, Frizzi claimed that the sales accounts submitted on behalf of Plans were not accounts of his company. The defense is of the opinion that this testimony is contradicted by objective evidence and documents, and therefore it is false and unreliable. The summaries also included a reference to a recording documenting a conversation between Araldo Parisi and Defendant 1, which according to the defense is inadmissible. In any event, so defendant 1 claims, the content of the recording supports his version and rejects Frisi's statements. This is because Frizzi understands very well what Roger it is and does not say anywhere that Plan did not make the said deals. In light of the aforesaid, defendant 1 argues that Plans was an active company at the relevant time that carried out real transactions for legal, legitimate and commercial purposes.
As for the Danidov company, it was also claimed that it was an active company, which was presented to defendant 1 "Haim" and "Avi", as a company that carried out real business and commercial activity. In any event, defendant 1 had no connection to Danidov and was not the owner of the company, and during the course of managing the transactions it was clear to him that it was a legitimate company, which was conducting real transactions and not a shell company. Defendant 1 said similar things about the Sevilla company as well.
