The evidence presented by defendant 1, in order to convince the court that he acted on behalf of PLANAS, with authority and permission, is manifestly false evidence, and I do not give it any weight, since it does not deserve any trust, as will be clarified below.
As part of Defendant 1's efforts to convince him that he acted on behalf of PLANAS, with authority and permission, Defendant 1 claimed that Defendant 3, Araldo Frizzi, referred him to a person named Christian Roger, who, according to Defendant 3, was the operator of the company in Belgium.
Defendant 1 claimed that the same Christian Roger gave him the pages of the PLANAS firm, and authorized him to generate supplier accounts on its behalf.
It should be said that I do not give any credence to this version, and I prefer the words of defendant 3, according to which the company was not active, and that he does not know a person named Christian Roger or any person with a similar name in Belgium, who is connected to the company PLANAS .
Later, counsel for defendant 1 asked to summon a man named Vensen Lo Duquet from Belgium to testify, while asking that his name and details not be disclosed, lest he be swallowed up by defendant 3 or his associates.
After the requested summons was issued, a person who identified himself as Vincent Le Duquet appeared in court, who claimed that he did indeed give the name of Christian Roger, as part of his relationship with Defendant 1. When he was asked what this meant, Duque testified that he tried not to use his real name in order to prevent the possibility of lawsuits being filed against him or the company, and therefore he informed defendant 1, as well as other parties, that his name was Christian Roger.
Le Duque said that he was behind the many transactions mentioned in the PLANAS supplier accounts, but as was rightly claimed by the prosecution, the witness did not point to any document to support his version.
Le Duque promised to make an effort to locate any documents, but in the end no documents were received from Belgium that supported or corroborated Le Duquet's version.
