The indictment, as part of the eighth indictment, deals with six shipments of goods from Opsa, for which a supplier's account was issued on behalf of Opsa to the company OPCI, in which the real price of the goods is quoted in Spanish pesetas. As far as the supplier is concerned, all the payments were received in accordance with the law, and there is no claim in this regard. The allegations appearing in the eighth indictment relate to the fraud of the tax authorities of the State of Israel, due to the presentation of a false representation, as to the identity of the importer and as to the identity of the supplier, and especially with regard to the value of the goods that were released from customs.
On page 217 of the summaries of the claim, there is a table comparing the real accounts of the supplier with the accounts of the supplier, which according to the version of the claim are false.
Indeed, from a comparative examination of the exhibits appearing in the table, it turns out that with regard to the first shipment, it was stated in the account of the real supplier that the importer was OPCI, with the value of the goods being 8,639,572 Spanish pesetas.
On the other hand, a supplier's account of PLANAS was attached to the import license (P/85), according to which the importer is the Danidov company, with the value of the goods amounting to 3,246,885 Spanish pesetas.
There is no dispute that Danidov did not serve as the importer of the goods, and there is also no dispute that PLANAS was not the supplier, and that the declared value of the goods is about one-third of the real value.
In the second shipment as well, the supplier is Opse, while the importer is OPCI, and the cost of the goods is 11,899,569 Spanish pesetas.
On the other hand, a sales account of PLANAS was attached to the import register, according to which the importer is the Danidov company, and the value of the goods is 4,165,581 Spanish pesetas.
In the third shipment, the real supplier's account shows the sum of 9,124,542 Spanish pesetas, while the supplier's account of PLANAS shows the sum of 2,740,204 Spanish pesetas.
