According to the Registrar of Companies documents (P/311), the company was founded in August 1996 by Yigal Fadlon, defendant 6, and Mario Weissman.
On October 20, 1999, the Registrar of Companies was notified of the transfer of the company's shares in the name of Shtgovsky Avraham of 3 Presidents St., Holon, and in the name of Forum Office Ltd., 1 Ga'aton St., Nahariya. On November 2, 1999, an announcement was given of the appointment of Sztgowski Avraham as a director of the company. The address of the company's office was registered at the office of defendant 3, Araldo Frisi, at 1 Ga'aton Street in Nahariya.
As may be recalled, Avraham Szegovsky, who was also registered as a shareholder in Danidov Ltd., testified at the trial and stated that he did not know about the transfer of shares in his name and his appointment as a director of the company. According to him, on page 1970 of the transcript, he knows nothing about the Marig company, he does not know the name Mario Weissman, and he does not know the Forum Office company in the tax appeal and the other parties involved in the affair. Defendant 1 was seen by the witness, for the first time, during the VAT interrogation.
Mr. Sztgowski was not asked any questions regarding the Merig company, in the course of his cross-examination by Attorney Gat, counsel for defendant 1.
The former owner of Forum Office Ltd., Meir Ben Shimon, also testified and stated that he was not familiar with the Merig company, and that he did not know how his company was involved in this matter.
It should be noted that Forum Office in the tax appeal was the company on whose behalf the goods were ordered in the charges
7-3, through defendant 3, who made use of this company.
The prosecution claims that the person who handled the transfer of the shares of the Marig company in the name of Avraham Sztgagovsky and in the name of Forum Office Ltd., is none other than defendant 1. According to the prosecution's approach, this is circumstantial evidence that shows, unequivocally, the involvement of defendant 1 in this matter.
