The main factor that complicates Defendant 1, as far as the Marig company is concerned, is Shlomo Matuk, who produced the Merig invoices at the time of the sale of the goods, which is the subject of the indictment.  In Shlomo Metuk's statement of 07.11.2000 (P/273), it was stated: "...And then Mario made an offer that he had an existing company with a low level of activity called Marig Import and Marketing and he was willing to have all the activity shared with Uri Resch, he is Mario Weissman, and I, when I get out of the bankruptcy process.  I went to Uri Resch and suggested the idea to him, and he accepted it."

Later, Shlomo Matuk says : "Uri Resh decided to stay in the offices in Rishpon, and he also brought Mario a person on his behalf who transferred the shares of Marig to him, and that ended the whole process."

He himself did not see the party, to whom the shares of Merig were transferred, but in his conversation with Mario Weissman he was told that things were done in an orderly manner and according to the procedures : "And Mario said that everything was fine with that."

When asked what the Merig company was involved in from the moment Mario Weissman left the company, and it was actually managed by Defendant 1, Shlomo Metuk replied : "The company was engaged in the import and marketing of electrical appliances, when my job was to sell the goods in the local market, when I received a paycheck and the money in cash, because I did not have a bank account."

He himself produced and delivered the invoices of the Merig company, since, according to him, the buyers of the goods did not know defendant 1.

In some cases, he was told by defendant 1 that the merchandise was not owned by the Merig company, and therefore invoices had to be issued by the owner of the goods.  According to him : "There were cases when I issued the invoices myself that were not in the name of Merig...".

In the same statement, Shlomo Matuk also referred to Schloss, stating that: "...Uri brought me the activity of this company to carry out."
