As for the forgery of Jan Schwartzman's signature, the prosecution states that it has not been able to prove where the name and personal details of the man, who was registered as a shareholder, appeared. However, once it has been proven that Defendant 1 is the one who controls ICT and JCC from the outset, it is clear that he and Shlosh are responsible for the fraudulent registration of the companies, including the forgery of Schwartzman's signature. The prosecution agrees that Frizzi cannot be linked to the forgery of the man's signature.
In addition, the prosecution relies on the mention of the name of Jan Schwartzman in the statement of Avi Kalmaro (P/338), defendant 4, in connection with JCC, and it is reasonable to assume that he heard this name from defendant 1.
Another piece of evidence linking defendant 1 to forging the founders' signatures and registering the companies in their names, without the knowledge and consent of the two, is found in the fact that defendant 1 did a similar thing in the straw company from Rig, in connection with Meir Ben Shimon. On February 22, 1999, defendant 1 transferred the shares of Merig in the name of Avraham Sztgagovsky and Forum Office Ltd., which was owned by Meir Ben Shimon, without their knowledge.
According to the prosecution's approach, defendant 1 was given a reasonable opportunity to defend himself against the charges attributed to him in the 18th charge. This is mainly because these are companies that were under his control and he was the one who made the decisions about them, from the beginning. Defendant 1 was given the opportunity to cross-examine Yehoshua Chelouche regarding this matter, but he did not see fit to take advantage of this right.
In light of the aforesaid, the court was asked to convict defendant 1 of four offenses of forgery with intent to obtain anything through him, under section 418 of the Penal Law, four offenses of false registration in corporate documents, under section 423 of the Penal Law, and two offenses of using a forged document, under section 420 of the Penal Law.
