As to the fact that the first container was released by defendant 1 without any consideration being paid for it, we can also learn from the recorded conversation of defendant 3 with Yehoshua Shlosh, from which it is clear that the goods were released and transferred for storage. Chelouche is quoted in this conversation as saying, when his words clearly refer to Defendant 1, "He took it to some warehouse in the universe, and waited and waited, until someone found out that something had happened with the computers...". Chelouche further tells defendant 3 that it is not desirable to work with defendant 1, because he tends to leave traces. He is also heard telling Defendant 3 "... The merchandise was seized, I said to Uri... If you take the goods you have to make sure you have a place, throw the goods, that's it, don't play. We have already taken the goods out, straight from the port." I will discuss the verdict in his case, so that in the framework of this discussion I do not see fit to express an opinion on the matter. However, it can certainly be said that defendant 1 acted to release the first container, using the original bill of lading, knowing that no consideration had been paid for it, whether in the framework of the letter of credit or in any other way.
There is no dispute that the four additional containers were released by means of forged certificates of exchange, which were allegedly issued by Carmel International Shipping Services Ltd., the ship's agent, for the benefit of Ltd. Contel (P/65; P/66). The fact that the gate certificates were forged was testified by David Nidam, who stated that the four containers were released according to them, pointing to differences between the forged certificates and the example of an authentic gate certificate (P/67). These certificates do not appear in the computerized system of the ship's agent who issued them, so to speak. Through Nidam, exhibits P/68, the report of the departure of two containers from the Contram warehouse, and P/69, the report of the departure of the other two containers from the Overseas warehouse, were also submitted.
