Reference to Additional Defense Arguments Raised by the Defendants

  1. Rosenthal's testimony from the project - As stated above, Rosenthal was an electronics technician who worked for many years at Elta and the Anemone project, that is, on the project side at Elta and not on the procurement side. Rosenthal testified at the trial as part of the defense case.

Rosenthal testified that he attended the meeting at UlTrade.  Rosenthal testified that the meeting was held after the procurement process had already been completed, "at the end of the procurement process", "just before the delivery" to Elta (p. 6684, paras. 14-15; p. 6683, paras. 8-10: "The last stage before [the equipment] is supplied to Elta"; p. 6686, s. 19: "The end of the process of purchasing the equipment").  Rosenthal testified that the meeting at the Alltrade took place  after an order for the equipment had already been issued, "there is already an order" (p. 6687, s. 30 - p. 6688, s. 2: "The equipment was in front of my eyes," from which he concluded that they had already received "confirmation that they were supplying" it to Elta; p. 6688, paras. 6-7: "The equipment is ready before delivery"); p. 6686, paras. 1-10: There is already an "agreement on money").  Rosenthal testified that Vered and he drove to Ultratrade to see that the equipment was intact and undamaged before delivering it; Because at the time of the meeting, the equipment was packed and ready to be shipped to Elta, and at Rosenthal's request, the equipment was opened and he asked to fill in the gaps that were found (p. 6683, paras. 18-29, p. 6684, paras. 5-10).  After Rosenthal was presented in his testimony that the documentation in Shachar's diary mentioned a meeting on June 1, 2010 on the subject of "demonstration of servers for the project", he confirmed that this was the meeting he was talking about, a meeting on June 1, 2010 (p. 6684, paras. 20-23, later he testified that he did not remember dates but that he was in the Ultratrade only once, so it seems to him, p. 6687, paras. 28-29, p. 6684, para. 24).  In his testimony, Rosenthal ruled out the possibility that after the meeting he described, the procurement company issued a request for quotes from other suppliers, since, as stated above, the meeting he described took place after an order had already been issued (p. 6687, paras. 1-9).
