Shohat's first e-mail message to Kashnevsky (N/450)

  1. On the afternoon of September 13, 2011, Shochat sent Schneevsky an e-mail message with the headline, "Price Quote for 3650 Servers" at a price of $8,155 per unit (N/450, N/450(1), N/456). This message will feature below Shohat's first email message.

There is no dispute that Shohat's first email refers to only one type of servers – the X3650 M3 servers  – of the four types in respect of which a price quote was initially requested (paragraphs 973-976 of the accuser's summaries, paragraphs 73 of the Shochat summaries; see also the SOW 1031P232-001 registration regarding the email that corresponds to the specification of one of the types of servers attached to the BLAM, N/95 at p. B28; and the testimony of Shohat, pp. 6754-6757, and in particular p. 6757, paras. 17-19; pp. 6858-6859, pp. 6880-6881).  Shohat's first e-mail constitutes, therefore, at most, only a partial response to the Oranim Police Department.

It was not clarified why Shochat sent Schnevsky the first email with a partial response.  In this context, it should be noted that P/450 – which is Shohat's first email message – was not presented to Shochat in his interrogations with the Authority (P/240, P/241, p. 6750, paras. 21-29).  It was also not presented to Shaknevsky (Shohat's arguments on this matter in para. 25 of his summaries were not contradicted).  In his testimony, Shochat did not recall why he sent Sheknevsky the first e-mail message (p. 6750, paras. 8-9, paras. 15-17) and assumed that he did so at Shaknevsky's request (p. 6750, s. 30 - p. 6751, s. 5).

As to the substance of the first email he sent to Skanevsky, Shochat claimed in his testimony that it was a specification, a technical response to the demand, and not a price quote (p. 6748, paras. 25-28).  This argument raises a difficulty.  It is ostensibly inconsistent with the title of the document "Price Quote for the 3650 Servers" and with the price for the unit at the bottom (and in certain places in his testimony Shochat inadvertently referred to the notice as a price quote, for example, pp. 6747, 21-22, when he later corrected himself; P. 6751, paras. 4-5).  On the other hand, as stated, it was not clarified how only a partial response was provided, but in relation to one type of servers and in a manner that does not comply with the requirements of the National Security Council (see also N/29 in relation to Shkanevsky's position that a consolidated procurement should be made for all the details of the contents).  According to the accuser's claims that this is part of the overall price quote submitted by Shochat on behalf of Matrix to the Oranim Police Department, we will be asked separately.
