Ben Shmueli, the CEO of the company that supplied the online pricing system to IAI, testified at the trial.  Ben Shmueli testified that as part of the usual course of events, the system automatically and in real time documents the online pricing data, the offers that are submitted, the actions that are taken, etc.; that the events are documented as they occur; and that after the completion of the online pricing, the system is locked and it is not possible to make changes to the data that was recorded, but only to print for the benefit of the person ordering the pricing (p. 2256, paras. 1-23; p. 2272, paras. 8-9 – the system records every action that is performed; p. 2282, paras. 1-6 – there is no such action that is not documented).  The manner in which the data is collected and documented therefore attests to the authenticity of the record's content.  The production of the record is done by printing the output without the possibility of changing the data as recorded in real time (p. 2356, paras. 14-19, it was printed from the system and it is impossible to change it).  Ben Shmueli further testified that the company regularly takes strict protective measures against penetration into the system or its disruption, taking into account the sensitivity required by various entities that make use of the system (p. 2257, paras. 1-14).  Ben Shmueli's testimony was reliable and not hidden.  The aforesaid is sufficient to prove that the conditions for the admissibility of the online pricing outputs are met as evidence of the truthfulness of their content in accordance with the provisions of sections 35-36 of the Evidence Ordinance.

Moreover, Ben Shmueli testified that no complaints were received about the reliability of the system or the data extracted from it (p. 2256, paras. 24-26) and that at the time of his testimony, about 160 organizations were using the system, including large and significant entities such as the Israel Electric Corporation, Rafael, the Clalit Health Fund and others, in a way that could also attest to its reliability (p. 2248, paras. 19 - p. 2249,  S. 2).  Moreover, the data documented in the online pricing plates correspond to the picture that emerges from the rest of the evidence and testimonies (for example: the time of the start of the pricing and the period of time it lasted (P/204, which is consistent with the orders, N/451, N/101 and with Shohat's words, P/240, paras. 521-522); his joining the pricing at a slight delay because he was unable to connect and required assistance on behalf of the user (P/211, which is consistent with Shohat's request,  P/614 and his testimony, p. 6767, paras. 12-17); Wee's winning bid (which arises from the online pricing outputs and is consistent with the correspondence after the pricing and with the order (P/102, P/142, P/124)).
