The accuser also referred to Shahar's testimony that the other participants in the pricing – Gilad, Wischnitzer and Shochat – agreed to Shachar's request not to lower the prices "excessively" (p. 2881, paras. 26 - p. 2882, para. 3, where he confirmed his statement from the interrogation, P/557(5), paras. 1047-1053; Later he testified that in general the others acted according to the agreement, even if not accurately, since in general the price of Wii was lower, p. 2882, paras. 5-8).

  1. Shachar's remarks in the testimony join the many phone conversations that took place between the participants in the online search. It should also be remembered that it was proven above that prior to the online bidding, an arrangement was made between the competing suppliers – Wei, EMET and Harel (while doubt remained regarding Shochat and Matrix) – and that Shahar sent Gilad, Wischnitzer and Shochet the prices for submission at the BLA stage.  All of these are sufficient to support the statements made by Shachar regarding the existence of an arrangement even at the stage of the online pricing (although the accuser was not precise in various places in her summaries of the matter that arises from Shachar's testimony in relation to the content of the arrangement).

However, a comprehensive examination of what Shahar said – in his testimony and in his interrogations at the PA – raises certain discrepancies and question marks regarding the content of the conversations that took place during the online pricing and the question of whether the exchange in the conversations amounts to the arrangement attributed to this part of the indictment.

We noted above that in general, discrepancies sometimes arose in Shachar's testimony.  We have also seen that with regard to the Oranim project, the impression arose that some of Shachar's words were not based on actual memory, but rather on documents presented to him (see paragraph 706 above).  Such discrepancies and inconsistencies were also discovered with regard to his statements regarding the content of the conversations between the participants at the online pricing stage.
