This is a central storage system purchased by Elbit for the site in Haifa and not for Elop, which is based in Rehovot (P/414 "Price Estimate for a Central Storage System at Elbit Haifa"; Oshri, p. 4610, paras. 6-19; Lavi, p. 1373, paras. 10-12; The transaction was handled by Mickey Biton, Elbit's IT systems manager in Haifa, and Asher Shalmon, who was the procurement manager at Elbit's headquarters in Haifa, for example, N/366, N/367, N/275; as well as the testimony of Oshri at p. 4606, paras. 4-6; Lavi, p. 1374, paras. 23-24, where she also testified that Salmon was not a procurement manager at Elop; from the evidence it appears that Lavi, or anyone else on behalf of Elop, was not involved in this transaction; see Lavi's testimony, p. 1362, paras. 1-21).
In the framework of the "Requirements Document" that Elbit characterized in relation to the central storage system that it sought to purchase from NetApp, the supplier was also required to specify a future price for the purchase of additional disk drawers (paragraphs 16 to N/366, paragraphs 17-18 were also required to offer future prices for software and maintenance licenses). In the updated price quote submitted by Wei – with the involvement of NetApp as stated above – included a clause regarding "optional costs at roof prices", in which costs for disc drawer additions were determined, inter alia, under "Hardware costs, volume expansions – option" (paragraphs 4 and 5.2 at p. 8 of N/275, N/124; Identical clauses were included in earlier versions of the Wii proposal – N/414, N/273, N/274). It should be noted at this point that it is clear from the language of the sections and from the testimonies that this is an option given to Elbit to purchase extensions in the future, to the extent it deems appropriate and at the maximum prices determined, and not Elbit's undertaking to purchase from Wei (Shahar, p. 3293, paras. 9-12, where he testified that Elbit is entitled to buy the extensions from whomever they wish and that the section gives them an option to purchase from Wee; even though he later testified that they would usually purchase from Wee; Oshri also used in his testimony the expression "option" that was given to Elbit, If you wish, p. 4605, paras. 14-16).
