EMET's proposal – the prices of EMET's proposal were NIS 145,500 for one CD shelf, excluding VAT, and NIS 436,500 for three CD racks, not including tax appeals (P/78, p. 23; N/292, and see also P/76). These prices exactly corresponded to the prices that Bayan had sent to Rubinstein a short time earlier (P/82; for the note on the issue of liability that A.M.T. mentioned on its proposal and the arguments on its basis, we will address it separately).
Wie's bid – Wie's bid prices were NIS 140,555 for one CD shelf, excluding VAT, and NIS 421,665 for three CD racks, not including tax appeals (P/77, p. 23; N/291; in the proposal, Shachar was mentioned as Wie's representative in response to the Mapi tender, P/77, p. 11). The prices of Wee's offer were, therefore, cheaper than the prices of EMAT's coordinated offering.
On October 11, 2011, the Ministerial Tenders Committee convened and unanimously selected Wei as the winner of the Mapi tender on the grounds that its bid was the cheapest in the tender (P/76, Tenders Committee Minutes, p. 1, pp. 7-8 (para. 5), N/297; see Notice of the Loan and Notice to A.M.T. That it did not win – P/79, P/560; Koren, p. 570, paras. 30-32).
Further to the aforesaid, WI and Mapi signed a contract for the supply of the discs and the provision of ancillary services, including their installation at Mapi (P/80, see also the correspondence in P/320).
- Purchase of the CDs from EMET in accordance with the agreement - After Wei won the tender from Mappi, Wei purchased the CD shelves for the purpose of supplying them to Mapi after E.M.T. purchased the shelves from Tap, and all in accordance with the agreement that was made in the first place between Wei and A.M.T. (P/82). Oshri was also involved in this stage of the execution of the summary.
As you may recall, Levi had a quote from Mantap for the purchase of the shelves at $27,000 per shelf, in cross-business at $81,000 for three shelves (see paragraph 792 above). After winning the tender, Wei wanted to purchase the shelves from A.M.T. at the same price (see P/277, an email from Babian to Oshri dated October 16, 2011). At the end of the day, WMT purchased the shelves at a price of $28,500 per shelf, and in antitrust for $85,500 for three shelves (P/561, correspondence dated October 26, 2011; Rubinstein, p. 3651, s. 3-23; A.M.T. purchased the shelves from TAP at a cost of $72,000, i.e., $24,000 per shelf, i.e., at a lower price than Netapp's original offer to E.M.T. - P/561, Rubinstein, p. 3652, S. 1-5; For correspondence between EMET and NetApp in connection with the order, see N/290).
