Zeiger's claim that he did not agree contradicts what emerges from the documents from real time. In the email correspondence, Zeiger clearly expressed his consent. It was he who chose the option of "walking together" in response to Nahum's first request. He wrote to Nahum, "We have closed." The parties had telephone conversations and discussions regarding the division between them. At Zeiger's request, Nahum clarified the arrangement in its details – including the submission of coordinated proposals while concealing the matter from Elta – and even presented a numerical example for clarifying the matter of the purchase of the contents from Triple C. In a direct response to this, Zeiger wrote back to Nahum "OK", meaning that he accepted the matter and that he agreed. This is also how Nahum understood it in real time when he replied to Zeiger, "Great. Closed," while informing Zeiger that he was beginning to work to promote the matter. To this, Zeiger replied once again, "Okay."
Indeed, in his retrospective testimony, Zeiger claimed that he did not agree to the arrangement, because when he wrote to Nahum "we closed" he meant that they had closed the dialogue between them (p. 5344, paras. 15-17), because when he replied to Nahum "OK" he actually said to Nahum, "Okay, I understand you... We have closed the dialogue between us" (p. 5357, paras. 13-21). However, these arguments should not be accepted. Zeiger's testimony on this matter was not reliable. As Zeiger himself confirmed, his version is inconsistent with the Bible from a real time. In fact, it seeks to empty them of their content. It is not for nothing that he found it difficult to answer the court's questions on the matter (p. 5344, s. 25 - p. 5346, s. 9, and see similarly, p. 5358, s. 14 - p. 5360, s. 11; the attempt to justify the conduct by saying that Nahum was senior to him and that it was not his job to educate him was not convincing; Zeiger himself was a dominant manager with status, and even with Nahum he did not hesitate and stood up for himself. For example, the demand that Harel be at the front). The things that Zeiger wrote in real time speak for themselves: Zeiger agreed to the arrangement (and in fact, when asked about it again in his cross-examination, he confirmed that when he wrote to Nahum, "If there is no difference, we closed," he intended to close the deal between them (p. 6044, paras. 14-21)). This is also how Nahum understood it in real time when he wrote to Zeiger later on, "Great. closed" while noting that he was beginning to "revolve" the matter, to which Zeiger also responded, once again, with agreement (see also N/187, P/500, where Nahum informed his men of Triple C in an unequivocal manner that the matter was "agreed with Harel").
