In any event, it is clear that the email message that Gilad sent to Zeiger on the evening of March 13, 2012, in which he detailed the prices of Wee, Triple C and Harel (to which three price quotes were attached) – without any distinction between Wee and Triple C – revolved around coordination prices, the prices that Wee and Triple C would be asked to submit to the funder in a coordinated manner (P/116, see also paragraph 1009 above).

Following this announcement – the essence of which is the planning of the coordination – Gilad Kashnevsky submitted Harel's offer and sent, at the same time, emails with quotes to the two competitors: one message to Shachar with a price quote in relation to which he wrote "Submit it" (P/353), and a second message with a price quote to Chasia from Triple C.  In this state of affairs, there can be no doubt that the offer for Triple C was also sent in order for Triple C to submit it to IAI, at the price indicated by Gilad and in coordination with Harel, exactly as it was done with Shahar and as part of the same conduct and the same process (P/116) and for the purpose of coordination.  Zeiger and Harel's arguments in this context, while attempting to distinguish between Wei (with which improper coordination was made) and Triple C (in relation to which it was claimed that there was no attempt to coordinate except in a tender offer), has no basis or presence.  This, whether in the words that Gilad wrote to Zeiger or in Gilad's conduct immediately afterwards vis-à-vis the two competitors (and it should be noted that in the answers of Harel and Zeiger to the indictment the argument in question was not raised, see paragraphs 31-32 of Zeiger's reply, paragraphs 28 of Harel's reply; in P/220, paras. 340-345 it was raised in weak language, "perhaps").

Beyond that, the price of the offer that Gilad sent to Chassia from Triple C (with a copy to Zeiger) (P/119, P/118), $357,646, exactly corresponds to the price indicated in the price table (for the coordination plan) that Gilad sent to Zeiger the night before (P/116); just as the price of the offer that Gilad sent to Shahar, $364,691, next to which he wrote to Shahar "Submit it" (P/353), is exactly matched The price table (although there is an exchange between the price of Wii and the price of Triple C).  This adjustment also undermines the arguments of Zeiger and Harel.  In addition, Zeiger and Harel's claim that there was an offer to Triple C for the purchase of equipment from Harel is also inconsistent with the bid file sent to Hassia.  This is a price quote in the form of a submission to a civil appeal (see, for example, P/112) detailing the "IAI price", i.e., the sale price for a civil appeal – exactly as it was done with Wii – and without a mention, hint or anchor that this is a sale price for Triple C.
