Moreover.  Zeiger himself said in his interrogation in response to questions about MPR(X) that the Civil Appeal asks for  price quotes in order to see if it is possible to get lower prices and thus "takes out the soul" of Harel (P/220, paras. 324-327, paras. 518-530, and see also paras. 260-263).  In other words, the request for price quotes is intended to hold true pricing and to receive true bids in order to obtain the best price for IAI, and not for the purpose of receiving idle coordinated bids.  Zeiger even testified that even when Harel believes that the deal is "hers," she always checks "so that we won't be surprised" and wants to ensure her win (p. 6073, s. 24 - p. 6074, s. 17; And the very attempt to claim that the coordination prices that Gilad sent him were a test and evaluation of the competitors' prices undermines the claim that the win was guaranteed).  Coordinating the price quotes with the other suppliers makes it possible to remove the fear of such surprises and the uncertainty that underlies the competition.

With regard to the claims based on Harel's involvement in characterizing the contents of the procurement for the project , the defense referred in its summaries to Shahar's statement in his testimony that Gilad and Harel had worked "for a year on the project" (p. 3030, paras. 21-22). But these words have no real weight.  They were probably raised, as an assumption, without any knowledge of Shachar, without any infrastructure or support (Shahar, p. 3031, paras. 3-6).  It was clear from Shachar's testimony that he did not remember the project at all (e.g., p. 3274, paras. 18-22).

Indeed, the evidence supports the fact that Harel had some involvement in characterizing the contents of the procurement vis-à-vis the project personnel at Elta (see N/79, Harel's proposal of January 31, 2012 to the project personnel at Elta, even before  the integrated MPR BMR  , at paragraph 964 above; see also the inscription in the technical specifications P/107(a)-(c) prepared by the project personnel; Shkanevsky, p. 1031, paras. 3-9).  However, as we have seen at length above, the preliminary activity of the supplier vis-à-vis the project personnel, including involvement in the technical characterization, does not guarantee a win and does not make the procurement process that the procurement bodies subsequently issue for pricing supervised (see paragraphs 276-284 above).
