Background
- Indra is a Spanish company, a kind of equivalent of IAI. In the framework of a joint project between Indra and ELTA, Indra sought to purchase the contents of computer equipment and storage from suppliers in Israel (p. 1128, paras. 22-24, P/164). It was ELTA that worked to obtain price quotes from various parties, including the defendant companies - Wee, Harel and Triple C - for the Indra project, when at the end of the day Indra purchased the contents of the equipment directly from We, whose bid was the cheapest.
- A central figure in the matter of this indictment is Jack Mordechai (Mordechai). Mordechai was a hardware engineer and planner at Elta, who was also given powers in the field of procurement, including the authority to carry out pricing and contact suppliers for quotations (p. 1220, paras. 13-18; p. 1126, paras. 9-10, paras. 18-22; p. 1127, paras. 12-20). Mordechai was the one who designed and characterized various systems for the Indra project, including the formulation of the technical solution for the computer, storage and server systems, and it was he who worked with the companies accused of receiving the price quotes on the subject of the privileged coordination (p. 1152, s. 22 - pp. 1-5; pp. 1150-1152, P/164).
- At the beginning of the process, from the end of 2008 until September 2009, Mordechai contacted various manufacturers to obtain price quotes in connection with the Indra project and to examine the contents of the equipment for the project (for example, an inquiry and quotes received from EMC , a manufacturer of storage systems - N/111 (January 1, 2009), N/226 (August 6, 2009 - September 10, 2009); a request and quotes from NetApp , another manufacturer of storage systems - N/224, N/410 (5 August 2009), N/114, N/228 (25 September 2009), N/115, N/231 (30 September 2009); Correspondence with HP regarding price quotes for servers and storage, N/112 (7 January 2009), N/225 (5 August 2009); P/164 where the entire process is described, including an appeal to IBM; see also N/3 (20 April 2009), where Mordechai, incidentally, notes in correspondence with Naveh from Triple C that the matter is also coordinated with IBM).
In between, there was also specific correspondence with some of the suppliers: with Triple C (Mordechai's request for a price estimate from Triple C - N/3 (20 April 2009)); and vs. Wei (purchase of certain equipment from Wee, on a small scale that is not directly related to the project - N/284 (June 17, 2009), N/113, N/376 (July 6, 2009), p. 1244, Q. 1-1245, S. 11).
