Immediately afterwards, Shahar updated Oshri on the progress of the coordination.  Shortly after the coordination correspondence between Shahar and Gilad, Gilad submitted to ELTA Procurement the Harel offer, which was coordinated with Wei, and informed Shahar that he had done so.  Shortly afterwards, after Gilad submitted a certain update to Elta's proposal to Elta, Shachar forwarded to Oshri the updated coordinated proposal submitted by Harel, together with the email correspondence between Gilad and Kinatork, and with Shachar stating that he was attaching Harel's proposal to Oshri (P/296).  In his interrogation, Shahar was asked – even before he was presented with the last correspondence – whether he had reported to Oshri that Gilad had submitted a higher offer than Wee's and that Gilad had sent Shahar the offer he had submitted, to which Shahar replied: "Oshri was probably aware of everything that was done, and of course as my manager he would have reported everything and approved everything" (P/557(9), paras. 359-362).  Subsequently, Shahar was presented with the last email correspondence, and he replied that he had sent it to Oshri "at his request" (ibid., paras. 363-366).  In his testimony, Shachar claimed that he did not know whether he had reported the matter to Oshri (p. 2700, para. 10) in a manner that was inconsistent with the email correspondence from real time and was unreliable.  Even after he was presented with the words from the interrogation, he tried to deny their correctness and raised arguments regarding the manner of the brutal interrogation, according to him, (p. 2701, paras. 9-13, this argument was rejected above, see paragraph 49 above).  The impression that clearly emerged was that Shahar was trying to reduce Oshri's role and adapt his answers to Oshri's interest.  Only after he was shown the email correspondence in which he conveyed Harel's proposal to Oshri in real time (about the correspondence that preceded it between Kniturk and Gilad) did he confirm that he had forwarded the email to Oshri – about Harel's suggestion in Shaw – "in order to update him" (p. 2702, s. 20 – p. 2703, s. 2, in a manner that is consistent with what he said in his interrogation, even though he tried again to qualify and exclude Oshri and claimed that this did not mean that Oshri wanted to see it,  in a way that did not make a reliable impression).  At this point, there is a clear basis for preferring Shachar's words in his interrogation regarding Oshri's involvement, who confirmed the remarks and that the update was sent to him at his (Oshri's) request.  These are consistent with the correspondence from a real time (which Shahar tried to deny at the time of his testimony), with the picture of the relationship between Oshri and Shahar and the manner in which they cooperated, as well as with the dominant role that Oshri played in navigating Wei's moves in the project in question.  In any event, and as stated above, even the things that came up in the testimony are sufficient to show that Oshri knew about the arrangement and agreed to it.
