Uri's claims were not hidden. The plaintiff did not present any evidence from which it can be learned that, as she claimed, Uri knew and/or anticipated the cessation of the rental of the property to luxury and the cessation of its activity, and certainly no evidence was presented to support the claim that Uri "got up and left suddenly".
When Roy was asked whether he could support the claims that "Uri did not take care of receiving funding", he did not act to inform the plaintiff of the termination of the engagement, and suddenly "got up and left", he replied as follows:
"The witness, Mr. Edri: I said, these are things that were apparently WhatsApp and have no trace of them at the moment. Beyond that, no.
Q: I mean, you're saying that Uri didn't bother to get funding for this period, and what your claim is, I don't have that?
A: Yes, look" (p. 43, lines 18-21 of the transcript).
Roy's answer speaks for itself. There is "no trace" of any evidence in support of the plaintiff's claims in this matter, and Uri's claims, which were detailed at length, were not concealed, and in any case the plaintiff did not prove her claim that Uri anticipated the termination of the rental of the luxury property, hid the aforesaid from her, did not act to minimize the damage, and suddenly "got up and left".
- Similarly, I did not find that the plaintiff proved the claim that Uri had "deceived" her and made a representation, according to which Prestige would meet its obligations, when at the end of the day, the engagement was terminated without the debt being paid to the plaintiff.
Uri stated that he was not afraid for a moment that Prestige would not meet its various obligations, in view of the rights and assets that Prestige was entitled to receive from the Ministry of Health, and from new operators of the nursing home (paragraph 27 of Uri's affidavit).
In his affidavit, Uri detailed that most of the nursing home's revenues were received from the Ministry of Health, which pays for each resident hospitalized there after receiving the approval of the Ministry of Health, and that, to the best of his recollection, the nursing home's income from the Ministry of Health was about ILS 1.3 million per month (paragraph 28 of Uri's affidavit).
