In addition, Uri stated that all the rights that reached Prestige at that time exceeded its debts, and even though there were temporary difficulties in receiving funds from the Ministry of Health, which stemmed from "procedural problems" and inquiries made by the Ministry of Health upon the entry of the new operator of the nursing home, it was clear that "the Ministry of Health owes the company funds for the defendant's period of operation (the period of the claim), and that these funds will reach Prestige and will be used to pay its debts (if any)" (paragraph 32 of Uri's affidavit).
Uri attached to his affidavit e-mails addressed to him by the Ministry of Health, dated August 16, 2022, in which it was noted that "in the AGM system, in the Corona procurement order, an invoice was registered for supplier 3L237 Yavneel Luxury Geriatric Institute," that the invoice date was August 16, 2022 and "Invoice Description Text: Corona Differences on Hold 05/21 - 05/20", and "Corona Differences on Hold 04/20-04/20". It was also noted that "payment will be made via Merkava in the coming days" (Appendix A to Uri's affidavit). The aforementioned constitutes further support for Uri's argument that the Ministry of Health was supposed to receive receipts from the Ministry of Health, as indeed happened in practice.
The plaintiff claims that she asked to receive "bank account documents" from Uri during the relevant period, but Uri replied that he did not have them. According to her, the aforesaid should be regarded as refraining from bringing evidence that acts in accordance with Uri's obligation. It is regrettable that this argument was raised by the plaintiff, when at the pre-trial meeting held on April 11, 2024, Uri, through his counsel, agreed that the documents would be provided to the plaintiff, and subsequently, the plaintiff's request for an order addressed to Bank Hapoalim was submitted, while it was noted in the application that Uri's counsel had given his consent to its submission. After signing an order on the matter, Bank Hapoalim submitted to the court file on June 9, 2024, "Details of current account transactions" of the Prestige account for the dates 1/2021-2/2022 (as noted, Prefecture's account was closed on February 15, 2022).
