The parties' arguments
For the sake of convenience, defendant 1 will be called "Prestige", even though its name was later changed, taking into account that on the relevant dates of the claim, its name has not yet been changed.
The plaintiff's arguments
The plaintiff supported her claims with the affidavit of Mr. Roy Edri, who testified that he was the owner, manager and director of the company (hereinafter: "Roy"). She also asked to summon David to testify, after the latter did not sign an affidavit, which was prepared by her and sent to him.
- The plaintiff claims that in accordance with the provisions of the agreement, Prestige provided her with Excel files every month detailing the list of employees sent by the plaintiff, their working hours and working days, and thereafter, and on the basis of those Excel files, she produced invoices for Prestige, while complying with its obligations in accordance with the agreement to the full satisfaction of the defendants, including the provision of luxury employees and payment of their wages and other expenses. According to her, Roy was in constant contact with Uri "and with the defendant's representatives regarding the provision of work", and in everything related to "payment of the service", he was in contact with Uri (paragraph 3 of Roy's affidavit).
On the other hand, it claims, during the period of the engagement, "Uri and Keinan delayed the payment of the payment" (paragraph 6 of Roy's affidavit), and the "defendant" paid her the consideration until June 2021 only, after which Vicky "stopped her work" with the plaintiff, without giving 30 days' advance notice as stipulated in the agreement, and without paying the plaintiff the consideration for the months of July and August 2021 (paragraphs 17-18 of Roy's affidavit).
The plaintiff clarifies that she is not demanding an additional sum for the termination of the engagement without prior notice.
