I will not deny that the doctrine, in its strict form, does indeed give rise to difficulties, and has not yet been used in our country (the aluminum case, p.  29), but I see no impediment to following the Ramat Chen case and applying the doctrine in its softened form in this case.

  1. In conclusion, I am of the opinion that there was room to impose liability on the directors, but their insurance coverage should be recognized, both according to the accepted rules of interpretation in insurance law and according to the doctrine of the insured's expectations.
