In contrast to Kotler's lack of action throughout the proceeding, there is the extensive involvement of Alfia CPA, in all matters related to the conduct of a group of tenants under the law firm of Shraga Biran.
Alfia, CPA, testified that he organized a group of about 161 tenants and worked in cooperation with the law firm of Shraga Biran. His involvement in client recruitment began and continued throughout the legal proceedings - the lawsuit was filed in October 2010 and the mediation agreement was signed in March 2019. (p. 12, lines 3-6, p. 20, lines 25-31). When the handling of the group moved to the legal stage, CPA Alfia continued to coordinate the handling and served as the liaison between the attorney and the lesseees. Among other things, CPA Alfia took care of opening a trust account, collecting each lessee's proportional share of expert funding, which was required, as well as updating the clients on an ongoing basis regarding the progress of the proceedings (pp. 12, 13, p. 14, lines 1-3, p. 15, lines 29-31, p. 19, lines 8-16, p. 31, lines 27-31, p. 32, lines 1-2, 4-6, 8). Adv. Shemesh testified that Alfia CPA organized a conference for the group: "Alfia held a conference for his group and we infiltrated there, Alfia took the entire market." (p. 39, lines 1-2).
According to the testimony of Alfia, CPA, "At a certain point when everyone understood that there is no competition here, yes and everyone has to connect together, so all the teams joined together under the leadership of Biran. All attorneys led by Biran,... They agreed on such an expert, such an expert, such an expert. Again there was a big expense and this time I had all the groups... I've coordinated... 200 ... clients" (p. 15, lines 11-16, 22, 24, 26).
Alfia, CPA, also said that there were clients who consulted with him, "Yes, they would pick up the phone for me, what do you think after 7 years, 49 years, it's expensive, it's cheap, yes, it would happen... I presented them as best I could... the possibilities" (p. 17, lines 5-6, 8, 10).
