In his summary, Zehavi further argued that given that Zelkovnik's name is mentioned in the report, and given that the defendant admitted that she had published a condemnation statement and contacted the media, support was presented that the defendant was the one behind the publication. However, the defendant attached the condemnation notice that was sent by her, and its content is not the same as the published content. However, it states that:
"The things that Natan Zahavi said today are blatant and contemptible. Needless to say, they have no place in the station's broadcasts, and we condemn them in every language. Freedom of expression also has red lines. The director general of the radio decided to suspend the broadcaster immediately and remove him from the microphone until an inquiry is held, after which decisions will be made regarding the future."
Apart from the fact that the content of the notice of condemnation is not identical to the publication on which the libel suit is based, and therefore it does not substantiate the claim and accordingly the source of the publication on which the claim is based is in the notice - I am of the opinion that in respect of the notice, the defendant has a defense against a libel suit in accordance with the provisions of sections 14 and 15(2( and (4( of the Prohibition of Defamation Law. This is because what is stated in the notice of condemnation in the first part constitutes an expression of opinion and is protected under the protection of good faith in publication, and what is stated in the conclusion with regard to its suspension is protected as it is true. Beyond all of the aforesaid, the plaintiffs based their claim on this ground, on the fact that due to the defendants' conduct, Zehavi was presented as someone who desecrated the sanctities of Israel and harmed the religious sector, but an examination of the two publications shows that in both of them there is not the slightest hint of these claims.
In these circumstances, the law of the cause of action relating to defamation is to be rejected, and this is what I instruct.
