"4. The station's position is that the radio program "Nervous Zahavi" is by its very nature an opinionated, stormy, warm discourse program and, as its name implies, "nervous".
- As part of the unique nature of the program, as well as Mr. Zehavi's very personal nature, the program sometimes conducts very emotionally charged conversations between the presenter and his listeners. To a large extent, this is the purpose of the program - to serve as a platform for a broad and poignant public discourse, and to reflect what is burning in the hearts of listeners in relation to current affairs and current affairs.
- Mr. Zehavi, by nature, is an opinionated, energetic, and sometimes "not refined" person, as you put it, but this is part of his great uniqueness, and in this way he manages to conduct poignant dialogues with his listeners and arouse great interest, which makes his program one of the most popular programs among listeners in Israel, on all the radio stations in the country. There is no need to elaborate on the importance of expressing these words on the airwaves, which allow for widespread freedom of expression, which is an essential asset for a democratic regime."
It is also detailed in paragraph 9 of this letter:
"We would like to emphasize that Mr. Zehavi expressed his request that when a complaint is being examined by you against him, you listen to the entire conversation (instead of settling for a dry transcript), and in this way you will be able to get an impression of how things were said and in what context. In many cases, listening will greatly change how you feel."
Similarly, during the month of April 2011, the Second Authority's complaint against the defendant regarding violations of the rules of ethics committed by Zahavi in his program was received - and this complaint was also handled by Adv. Sommer, who clarified the station's position regarding the freedom of expression of its broadcasters, and in the process also clarified the essence of Zehavi's program (Appendix 3 to Adv. Sommer's affidavit).
