(2( He took the note in good faith and for its value, and at the time the note was traded for him, he had no knowledge that the property right of the trade was impairedV.
The defendant claims that the plaintiff took a note that was incomplete and proper according to its appearance, since it was a check for the beneficiary only, which bore the name of two payees. According to her, the purpose of a check for the beneficiary alone is to prevent its offenses and merchandising, and therefore the registration of two beneficiaries in such a check is contrary to the purpose of the check drawn to the beneficiary only.
I did not find that there was a defect in the check in question, and the plaintiff's claim that she took the check when it was intact and in good condition according to its appearance was not contradicted. The name of the payee in the check is written uniformly, in the same handwriting and in the same pen, "Maor Towers and/or Opel Balance", and therefore it is a complete and proper deed. The circumstances do not apply to other municipal applications (Tel Aviv-Jaffa District( 2010/05 Shahaf Tex Ltd. v. Avigdor Feldman, [Nevo] February 1, 2006, to which the defendant's counsel referred, since there it was determined that since the appellant in that matter took into her hands the document, which purported to be a check, while it was missing the name of the payee and added her name herself, it cannot be said that she took into her hands a note that was complete and proper according to its appearance. Therefore, the manner in which the names of the payees were written should not have raised suspicion on the part of the plaintiff since she demanded that the contractor do so.
There is no impediment to writing two payees on a note, even if it is only for the beneficiary, section 6(b( of the Banknotes Ordinance states:
"The note may be made payable to two or more persons together, or it may be made repayable alternatively to one of two payees or to one of several payees; It may also be repayable for the office holder at that time."
