Conclusion and Reference to the Issue of Expenses
- In view of the above, I hereby order the dismissal of the claim.
- The defendant is entitled to its expenses in respect of this proceeding.
In a motion filed on June 2,2026, the defendant drew attention to the high amount of the claim (initially at ILS 2.5 million and later at ILS 1.5 million); to the plaintiffs' faulty procedural conduct, according to her, in the conduct of the proceeding, which led to its prolongation and complexity; and to the fact that she actually bore the payment of attorney's fees of approximately ₪72,000 (approximately ILS 250,000 in today's values).
The defendant petitioned to charge the plaintiff with legal expenses in the amount of 72,000 euros, plus VAT"M.
- Indeed, it should be taken into account that the defendant was exposed to a relatively high claim amount (initially ILS 2.5 million and later ILS 1.5 million), and that quite a few efforts were required in conducting the proceeding, which included three evidentiary sessions; cross-examination of quite a few witnesses and experts; the submission of affidavits of testimony on behalf of the defendant as well as a number of expert opinions; and submission of written summaries of arguments, all in relation to a considerable amount of evidentiary material.
The sum of the expenses should be commensurate with all of the above, but I do not believe that there is any reason to charge the plaintiffs with attorney's fees in the sum of approximately ILS 250,000, even if the defendant actually bore it.
- Taking into account all the facts and considerations in the matter, and taking into account the amount of the claim to which the defendant was exposed and the rules of the Bar Association regarding the minimum rate of legal fees, I found that the plaintiffs (jointly and severally) should be obligated to pay the defendant legal expenses (including attorney's fees), in the total amount of ILS 100,000 (ILS 100,000), an amount that includes both attorney's fees for conducting the proceeding and various expenses incurred by the defendant in conducting the proceeding. Including the costs of experts on its behalf.
The amount will be paid within 30 days, otherwise it will bear linkage and interest differentials as required by law until the actual payment date.
