Shortly thereafter, the defendant called his brother, Karim Abu al-Qi'an (hereinafter: "Karim"). Karam, who at the time was in possession of the Dodge, drove it to the defendant's house. Parallel to the events described in paragraphs 11 and 12 above, the deceased, after spending a few more minutes at the washing machine, returned to his home, and a short time later, left the house and began walking on the left sidewalk up Al-Tikwa Street, towards the intersection of Al-Tikwa and Al-Duha streets (hereinafter: "the intersection").
The defendant, immediately after Karam arrived at his home with the Dodge car as stated in paragraph 12 above, at 18:51, or thereabouts, left the house and entered the driver's seat of the Dodge car while Karam moved to the front passenger seat, and immediately afterwards began driving it towards the intersection, even though he did not have a suitable driver's license to drive the Dodge car.
When he reached the intersection, the defendant turned right onto Altikva Street, and when he noticed the deceased walking in front of him on the left sidewalk in the direction of the intersection, he immediately accelerated his speed while diverting the Dodge vehicle to the left, in the direction of the deceased walking on the sidewalk as aforesaid, until he climbed on the sidewalk with the left wheels of the Dodge, in order to hit the deceased with the Dodge vehicle with the intention of killing him.
The Ottoman Settlement [Old Version] 1916The deceased, who noticed the Dodge approaching him, fled from the left sidewalk onto the road in order to avoid hitting him, but at this point, the defendant swerved the Dodge from the left sidewalk back to the right, towards the place where the deceased had reached on the road, caught up with the deceased and hit him hard with the front right corner of the front of the Dodge car, intending to kill him. The force of the impact slammed the deceased into the road and the Dodge vehicle, which continued driving, overtook the deceased and ran over him with the two right wheels of the Dodge.
