In his first interrogation, the defendant was asked explicitly about an argument he had with the deceased before he ran him over. The defendant denied any argument, as well as acquaintance with the person who ran over him: "There was no argument, I don't do such things and I don't know him... There was no argument..." He even went so far as to try to convince the interrogator of the truth of his words, stating: "Bring them to look me in the eye and say that there was an argument... There was no argument... (P/24, p. 9). In his answers, the defendant is in fact lying twice: once, because he knows the deceased well, and the second time, because of his version in court (which is not disputed) that there was an argument between him and the deceased, who told him not to press the gas pedal and make noise near his home.
This contradiction was hurled at the defendant in his cross-examination. At first, he answered that he did not know what to do after he was charged with murder and that "in the second interrogation I told them exactly what happened with me." Later he tried to explain this with a lack of understanding because "... there is a lot of time that Muhammad had passed, not on that day after his time at school" (even though the interrogation showed him a picture of the deceased, so the claim of confusion between people with a similar name is not relevant at all).
The defendant claimed in his second interrogation with the police that the incident in the washing took place "between 3:30 and 4:00 p.m.", and from the time it ended until the car-ramming, "between half an hour and an hour" had passed (P/8, p. 4). This was also claimed in the response to the indictment.
This answer of the defendant is very far from reflecting things as they are, and we will explain.
The defendant's version is that after the incident in the wash, he drove home with the Avensis (see, inter alia, P/8(a), Q. 3) when there is no allegation that in between, he went to another place. He further said that after the incident, he spoke with his brother Karam and told him to come with the dodge (according to him, in order to collect things with the dodge for his brother's event).
