Scenario B: The court grants the request ex parte. An examination of the WhatsApp messages between Reuven and Shimon reveals photos of Reuven being photographed with two MAG machine guns and a Negev machine gun, and correspondence between him and Shimon regarding the price of these weapons. From here, the investigation continues, at the end of which the aforementioned weapons are located in the warehouse of Reuven's home, and in the yard of Shimon's home a cache of weapons is located that includes ten pistols, two machine guns and two rifles M-16. The two are being indicted for weapons offenses.
Scenario C: The court holds a hearing on the application in the presence of the parties. Reuven's defense attorney demands that the police officer who conducted the preliminary search be brought to the hearing and asks him why he did not file a request for an appropriate search warrant. Later, the defense attorney asks the interrogator why he wants to review the WhatsApp correspondence between his client and Shimon. The interrogator refuses to answer. According to the defense attorney, the questions are intended to prove the connection between the material found in the illegal preliminary search on the phone and the request for a warrant to allow for an additional search. The court is hearing whether the interrogator should be obligated to answer the question or not. In the meantime, Shimon, who heard that Reuven had been arrested, rushed and removed the weapon from Reuven's yard and home.
Scenario D: The court grants the request ex parte in light of the concern that the investigation proceedings will be disrupted and thwarted. The court raises the question of admissibility on its own initiative and examines the issue both according to the Issacharov rule and through the lens of the doctrine of protection from justice and the doctrine of administrative review in criminal cases. Since this is a mere suspicion, which stems solely from the fact that Reuven spoke with Shimon, and since the policeman snatched the phone from Reuven, the court rejects the request. The police appeal to the District Court.
