Hani also added that she had asked to "open" the phones in order to find assets or funds that Effie had smuggled out of her, as well as "information related to women" (par.  p.  224, s.  4, p.  232, s.  26-28, p.  238, s.  22-23).

Yuli also confirmed in his testimony before me that the content that was produced from the devices was personal content that belonged to Naveh.  According to him: "...  the phones had pictures ...  a family phone is not" (p.  312, paras.  2-8).

  1. This matter is consistent with a number of non-controversial exhibits in the trial:

A memorandum drawn up by Deputy Superintendent Assaf Walfish on January 1,2019, in which Steif described the materials produced from the devices (P/19).  This description supports the conclusion that these are personal content of Naveh.

A judicial decision in the process of returning a seized item from October 10,2021, in which the judge ruled Alaa Masarwa that: "The contents of the devices and the material produced from them, which were the focus of the dispute between the parties, belong exclusively to Respondent 1" (Naveh - A.S.) (P/48).

  1. Significant parts of the materials produced from the phones were arranged in binders, which Shteif reported to the police and to Fish. These contents were presented to those who were summoned for questioning by the police in the "Sex for Appointment" affair.  The statements given during the police interrogation are presented in the present proceeding.  From the messages it can be learned that all the content presented to the interrogees pertains to Naveh.  Some of them are highly personal and some relate in one way or another to Naveh's public activity.  The nature of the information strongly supports Naveh's version that the information produced from the phones was highly personal, one that naturally belongs to Naveh alone.

            For these reasons, I determine that the information that was stored on the phones was in Naveh's complete privacy.  The protection of the devices by means of a password indicates Naveh's legitimate expectation of protecting his privacy.
