Third, at first, Naveh also sued Shimon Elkabetz (commander of Army Radio at the time).  However, in light of the tragedy that befell him and his family in the events of the October 7,2023, massacre, Naveh decided to drop the lawsuit against him, and this was deleted without an order for costs.  However, Mr. Elkabetz testified before me in the course of the proceeding.  Therefore, the judgment will also include references to his part in the affair.

  1. And now we will return to our matter - in the years 2015-2019, Naveh served as the head of the Israel Bar Association. In 2018, Naveh was interrogated on suspicion of fraudulent receipt and of the offense of The Entry into Israel Law.  The background of the investigation is two incidents: On September 20,2018, while leaving Israel for Thailand, Naveh identified himself at an automated post and received a "Gate Pass", which he gave to his partner, Bar Katz, who did not identify herself.  Bar Katz passed through the crossing gate using Naveh's permit, while Naveh clung to another passenger and passed with her at the same time, thus concealing Bar Katz's exit from Israel.  On their way back to Israel on October 2,2018, the two repeated the same action: Naveh received a passage permit and handed it over to Bar Katz, who passed through him.  Naveh clung to Bar Katz and passed with her through the crossing gate, thus concealing Bar Katz's entry into Israel.  This incident at the entrance to Israel was observed by Kiryat Gvulot, which noticed their conduct and detained them for interrogation.

 

  1. Naveh confessed during his interrogation to committing the act and to helping his wife leave the country without passport control. On December 25,2018, indictments were filed against Naveh and his partner for leaving Israel illegally, entering Israel illegally together, and fraudulently accepting something together.  Upon the publication of the suspicions against him, Naveh suspended himself from the Judicial Selection Committee, and upon the filing of the indictment, he announced his retirement from the Judicial Appointment Committee.  This affair was accompanied by many publications and remained on the public agenda for a long time (N/7, N/19, N/23, N/26).  For the sake of completeness, I will note that on September 20,2022, Naveh was convicted of two offenses of leaving Israel illegally and of two offenses of entering Israel illegally, according to Sections 7 and12(4) of the Entry into Israel Law, 5712-1952 (hereinafter - The Entry into Israel Law).  In addition, Naveh was convicted of two offenses of fraudulent receipt of a thing together according to Sections 29 (Risha) and415 of the Penal Law, 5737-1977 (hereinafter - Penal Law).
  2. Even before that, Hani and Naveh found themselves in a crisis in their marriage.

According to Hani: "...  I found out that he was cheating on me in the middle of June, around July 3, he was no longer home, and a month later, after I confronted him, he filed a request against me for dispute resolution" (par.  p.  221, paras.  5-7).  According to her, "We went to mediator Yaakov Cohen, Effie did not agree to submit any document, I negotiated with my eyes closed, only according to information I obtained on my own" (par.  p.  223, paras.  21-22).
