What is the amount charged?
- In the statement of claim, the plaintiffs petitioned to obligate the defendant to pay compensation for the delay in delivery in the total sum of ILS 958,084, which expresses the real compensation for the delay in the delivery of the apartments, which constitutes a calculation of 150% of the real rent for the apartment for eight months multiplied by the number of months in which the delivery of the apartment was delayed, and 125% of the real rent for the apartment multiplied by the continuation of the number of months for which the period of delay in the delivery of the apartment continued, according to a similar rental value in the area, and each apartment according to its damages. In addition, they sought to oblige the defendant to pay a total of ILS 29,493, which expresses the interest compensation and linkage of all the apartments, from the original delivery date set in the sale agreement, until the actual date of delivery.
Appraisal Expert Opinion Regarding Proper Use Fees
- In view of the rejection of some of the defendant's claims for an exemption from late delivery, the court must calculate the compensation. The parties disagreed regarding the amount of the appropriate rent. Therefore, the court appointed an expert on its behalf for real estate appraisals. The expert determined in her opinion as follows:
