Added to this is the contradiction regarding the period of residence of the defendant in the motel – according to the list of unpaid tenants, this is a period of one year, while according to the testimonies of the two defendants, it is only three months. When the defendant was confronted with the contradiction, he tried to explain that for the rest of the year he wandered between the two houses. However, the defendant did not provide details on this matter, and this argument was not supported by the defendant, who testified, after being confronted with what was stated in the list, that it was a period of only three months.
In addition, the list of free tenants shows a record according to which the defendant's parents, who live permanently in Germany, stayed in the motel from January 14, 2016 to November 26, 2016 (a period of ten and a half months) and also from August 13, 2016 to October 17, 2016. In addition to the fact that the second period is already included in the first period, the defendant denied that her parents had stayed in Israel for such a long period and explained that her parents were prevented from leaving Germany for a period exceeding two months.
The contradictions reviewed above indicate that the contents of the list of unpaid tenants drawn up by the defendant should not be trusted.
- As for the defense's argument regarding the provision of three housing units in the motel for the permanent use of the association free of charge, the defense's version in this matter is inconsistent and is not even evidence-based, as I will detail below.
When were the units transferred for use by the association? In the list of free tenants, in each of the years 2015, 2016 and 2017, an identical note appeared according to which "at least, aged 10-12, residents of the "Chance for Life" association lived. I have already noted that no trust was placed in this list, which was prepared at a later date by the defendant and was found to be unreliable. On the other hand, in the summaries of the defense, a different version appeared: the transfer of the units for the use of the association took place in 2016 and until 2018 (not from 2015, nor until 2017).
