Main Inquiry
- During the period relevant to the indictment, Yifrach served as a Logistics Support Officer (TAL) at Neve Tirza Prison. In this position, he was responsible, among other things, for budgets transferred to the prison for the maintenance of the prison and for local projects in the prison.
- A price quote of shutter rafts was submitted to the project that is the subject of the indictment, before Hatuka's offer, in the amount of NIS 18,565 including VAT (P/94). This offer was not made, because the defendant brought the cut. The offer was made of cut, wood, and not the offer of the shutter frames, made of aluminum. The witness objected to the order of the frame that went out to the cut for about NIS 37,000, claiming that it was a crazy amount and illogical for the purpose of closing two wooden walls. In response, the defendant "went wild", shouted and said that he was not willing to carry out any project with the witness. The witness told the prison headquarters that he refused to open this sum with his permission, and the authorization was opened by the district and not by the witness (p. 549).
- When asked why he was afraid of the accused, the witness replied that the defendant had power and that the defendant even humiliated him several times in front of the district commander of the Tal Corps, Mark Alfasi, and also went up to the witness's headquarters and told her that he did not want to work with the witness. Yifrach was afraid of losing his position (p. 550).
Cross-examination
- The witness was asked about his statements in the interrogation on December 7, 2017, that he was afraid of the defendant, and explained that the defendant used to approach the commanders and "get dirty on him." This also happened before the project that is the subject of the indictment. The two were not at odds on a personal level, the problems arose as a result of the projects (p. 552). According to him, anyone who does not align himself with the defendant's wishes in the project becomes his enemy (p. 553).
- The witness claimed that construction with aluminum is supposed to be more expensive than wood, but he did not know how to name the prices of aluminum and wood today (p. 564). The witness reiterated that the simple work of closing two wooden walls at a low height should not cost NIS 37,000 (p. 565).
- To the argument that the defendant supported the cheap offer of blinds, and that the reason this proposal was not carried out was the objection of the prison headquarters, which demanded that the construction be made of wood and not aluminum, so that the construction would be compatible with other nearby buildings, he replied that he did not remember what the commander's position was on the matter (pp. 566-567).
