Main Investigation (Transcript of January 23, 2023)

  1. The defendant testified that during the relevant period the relationship with Klaus was excellent, but it was not a relationship of dependence (p. 502). To the question of whether he had the opportunity to assist Klaus in obtaining work at the IPS, he replied: "Not that I did not have the opportunity, any main contractor can take a subcontractor or a worker and do work with him" (p. 502).

Cross-examination (transcript of March 27, 2023)

  1. Conversation No. 404 of January 30, 2018 - The conversation between the defendant and Klaus regarding work at the house of the defendant's brother-in-law in Alfei Menashe, in which Klaus stated that he would not make much profit from this work, the defendant said: "Okay... at least I will make a profit, what, take care of the friend," and Klaus replied: "... If you make a profit, then I will also make a profit." The defendant explained that his profit is from bringing a suitable professional to work for his relative, and Klaus' profit is in relation to the defendant's relationship with him (p. 500).
  2. Conversation No. 508 of February 1, 2018 - Conversation regarding the renovation of the defendant's home in February 2018 (p. 500). In the conversation, Klaus told the defendant that there was no chance that he would succeed in doing the project for NIS 7,000 as the defendant had estimated, but in the end he told the defendant – "Well, I'll take care of you." The defendant confirmed in his testimony that he did not agree to Klaus's offer (p. 500).
  3. Call No. 1283 of February 12, 2018 - Conversation regarding the surface that Klaus had prepared for the defendant's son for a rented apartment. The defendant complained in the conversation that Klaus was not meeting the schedule he had promised, and Klaus described in the conversation that he was running and running wild for the defendant and his son. According to the prosecutor's claim that Klaus's effort was in order to please the defendant, the defendant replied that the reason was a friendly relationship between the two (p. 501).
  4. Conversation No. 1576 of February 15, 2018 between the defendant and Klaus, about 20 seconds after conversation No. 1575 between the defendant and Marina, a tenant of an apartment in Pardes Hanna who complained about the solar water heater. In conversation No. 1576, Klaus told the defendant that he had no cash at the time. When asked why Klaus said this, the defendant replied that he did not know and that Klaus should be asked (p. 502). The defendant claimed in his testimony that in this conversation he told Klaus to take the boiler that he had installed at the defendant's brother-in-law and install it in the apartment in Pardes Hanna (p. 503). The defendant rejected the plaintiff's claim that this was not what was heard in the conversation and that the defendant had called Klaus so that he would pay for the new uncle in the apartment in Pardes Hanna (pp. 504-505).
  5. P/143 - A statement of Klaus's income and expenses, in which an expense of NIS 9,000 appears to "Arkady", with no other Arkadi in Klaus's contacts besides the defendant. The defendant denied the claim that Klaus paid him NIS 9,000 (p. 509).
  6. Call No. 1481 of February 14, 2018 - The prosecutor claimed that in this conversation the defendant tells Klaus that he is waiting for an explosion because when there is an explosion they don't ask how much the work costs ("Ten or a hundred is the same for them, when there is an explosion"). The defendant denied this (p. 512).
  7. Conversation No. 2327 of March 12, 2018 - A conversation between the defendant and Klaus on the subject of the Central District Intelligence Doors, regarding an incident in which Jackie Levy brought a professional on his behalf to perform the same work and the quarrel with the defendant (p. 514). The defendant claimed in his testimony that Levy had brought a relative who had made a cheaper offer, while the prosecutor claimed that Levy had not mentioned on the witness stand that he was a relative and that he had not been accused of this claim (p. 514). To the question of whether Levy thought that the offer brought by the defendant was high, the defendant argued that there was no possibility of adding or subtracting the price, since there was a bill of quantities and an audit of a number of people (p. 515).

Call No. 2531 of March 14, 2018 - In the conversation, Klaus informed the defendant that Jackie Levy had brought a professional on his behalf and went up with him to the intelligence floor.
